Welcome to Life with PassionThe following are the rules or "Terms" that govern use of the Life with Passion Website ("Site"). By using or visiting the Site, you expressly agree to be bound by these Terms and to follow these Terms and all applicable laws and regulations governing the Site. Life with Passion and Life with Passion.org (collectively "Life with Passion") reserve the right to change these Terms at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. We will note when there are updates to the Terms of Use at the bottom of the Terms. If you violate these Terms of Use, Life with Passion may terminate your use of the Site, bar you from future use of the Site, cancel your ticket order, and/or take appropriate legal action against you.Permitted UseYou agree that you are only authorised to visit, view and to retain a copy of pages of this Site for your own personal use, and that you shall not duplicate, download, publish, modify or otherwise distribute the material on this Site for any purpose other than to review event and promotional information, for personal use, or to purchase tickets or merchandise, unless otherwise specifically authorised by Life with Passion to do so. You also agree not to deep-link to the site for any purpose, unless specifically authorised by Life with Passion to do so. The content and software on this Site is the property of Life with Passion and/or its suppliers and is protected by Australian and international copyright laws. We post a legal notice and various credits on pages of the Site, which may not be removed. Please do not remove this notice or these credits, or any additional information contained along with the notices and credits.Ticket Purchase PolicyPlease review the Purchase Policy, which will govern your order or purchase of any tickets through the Site.Truthfulness and Accuracy of the Information You Provide; Complying with Laws; Verifications and AuthorisationsThe sale or purchase of tickets to entertainment events is regulated by certain states and cities. You may be asked to provide information during processes you engage in on the Site. You represent and warrant that all information you provide will be true, complete and correct, and that you will update all information as it changes. You also acknowledge that complying with laws is your responsibility, AND YOU AGREE NOT TO HOLD US LIABLE FOR YOUR FAILURE TO COMPLY WITH ANY LAW OR OUR FAILURE TO NOTIFY YOU OF, OR PROPERLY APPLY, ANY LAW. WE WILL COMPLY WITH LAW ENFORCEMENT AND MAY PROVIDE THEM WITH ALL INFORMATION YOU SUBMIT TO US TO ASSIST IN ANY INVESTIGATION OR PROSECUTION THEY MAY CONDUCT. If we are unable to verify or authenticate any information or tickets you provide during any registration, ordering, purchase, ticket posting, sale, authentication, delivery, payment or remittance process, or any other process, or if we are no longer able to verify or authorise your credit card or bank account information, you may be prohibited from using the Site.User Contributions to the SiteFrom time to time, the Site may provide you with opportunities to contribute to the Site, which may include, but not be limited to, uploading your user profile, participating in chats and using bulletin boards. Anything that is contributed to the Site by you or other Site users will be referred to in these Terms as "User Content". Life with Passion is not liable or responsible for any User Content. The contributions of third parties do not necessarily represent the view or opinions of Life with Passion. Life with Passion cannot preview User Content before it appears. Users can be held liable for any illegal or prohibited User Content they provide to the Site, including among other things, infringing, defamatory or offensive materials. If you discover this kind of material on the Site, please notify us at customer.service@LifewithPassion.org We will investigate your claim and may then take the actions deemed appropriate.Links and Search ResultsThe Site may automatically produce search results that reference or link to third party sites throughout the World Wide Web. Life with Passion has no control over these sites or the content within them. Life with Passion cannot guarantee, represent or warrant that the content contained in the sites is accurate, legal and/or inoffensive. Life with Passion does not endorse the content of any third party site, nor do we warrant that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against Life with Passion for any damages or losses, whatsoever, resulting from your use of the Site to obtain search results or to link to another site. If you have a problem with a link from the Site, please notify us at customer.service@Life with Passion.org and we will investigate your claim and take any actions we deem appropriate in our sole discretion.Prohibited ContentThe following is a partial list of the kind of User Content which is illegal or prohibited on the Site. It includes User Content that:

Is patently offensive to the online community, such as User Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual; could be harmful to minors;
Harasses or advocates harassment of another person;
Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming";
Promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
Promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
Contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
Displays pornographic or sexually explicit material of any kind;
Provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
Provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
Solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
Engages in commercial activities without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

Offline ConductAlthough Life with Passion cannot monitor the conduct of users off the Site, it is also a violation of these rules to use any information obtained from this Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit or sell to any Site user without their prior explicit consent.Commercial UseNo bulletin board, chat or other areas of this Site may be used by our visitors for any commercial purposes such as to conduct sales of tickets, merchandise or services of any kind. You must obtain our prior written consent to make commercial offers of any kind, whether by advertising, solicitations, links, or any other form of communication. Without limiting the foregoing, you may not use the Site to resell or link to other sites for the purpose of selling tickets of any kind. We reserve the right to block access to this Site or Life with Passion's other services, or cancel a ticket order or ticket with respect to any person believed to be, or believed to be acting in concert with any person who is believed to be, violating the law or these Terms or Life with Passion's rights, or utilising automated means to process or place ticket orders, or who has ordered a number of tickets that exceeds the stated limit. Violating any limitations or terms on the Site will be deemed to be a violation of these Terms. Access and InterferenceYou agree that you will not use any robot, spider or other automatic device, process or means to access the Site. Nor shall you use any manual process to monitor or copy our web pages or the content contained thereon or for any other unauthorised purpose without our prior expressed written permission. You agree that you will not use any device, software or routine that interferes with the proper working of the Site nor shall you attempt to interfere with the proper working of the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. You agree that you will not access, reload or "refresh" transactional event or ticketing pages, or make any other request to transactional servers, more than once during any three second interval. You agree that you will not copy, reproduce, alter, modify, create derivative works, or publicly display any content (except for your own personal, non-commercial use) from the Site without the prior expressed written permission of Life with Passion.Unauthorised Use of the SiteAny Illegal or unauthorised use of the Site shall constitute a violation of these Terms of Use. You do not have permission to access the Site in any way that violates, or in the course of violating, these Terms of Use. Illegal or unauthorised use of the Site includes, but is not limited to, using the site to facilitate illegal ticket sales, unauthorised framing of or linking to the Site, or unauthorised use of any robot, spider or other automated process on the Site. It shall also be a violation of these Terms of Use: (a) for any individual (or group of individuals acting in concert) to request, more than 1000 pages of the Site in any twenty-four hour period (hereafter referred to as "Abusive Use"); or (b) to use any passcode or password, regardless of whether or not such password or passcode is unique, to participate in a pre-sale or other offer on the Site if you are not the original recipient of such passcode or password (i.e., if you did not receive the passcode or password from Life with Passion, or from the fan club or other organisation with whom Life with Passion is working to enable such pre-sale or offer) or if your participation in such pre-sale or other offer is inconsistent with such pre-sale's or offer's terms.Suspected Violation of these Terms of Use or Law; Injunctive, Equitable Relief, and Liquidated DamagesViolations of these Terms of Use, including Unauthorised Use of the Site, may be investigated and appropriate legal action may be taken, including without limitation civil, criminal and injunctive redress. You understand and agree that in Life with Passion's sole discretion, and without prior notice, Life with Passion may terminate your access to the Site, cancel your ticket order or tickets acquired through your ticket order, cancel your ticket postings, remove any unauthorised User Content or exercise any other remedy available, if Life with Passion believes that your conduct or the conduct of any person with whom Life with Passion believes you act in concert, or the User Content you provide, or any resale of such tickets purchased through Life with Passion, violates or is inconsistent with these Terms or the law, or violates the rights of Life with Passion, a client of Life with Passion or another user of the Site. You agree that monetary damages may not provide a sufficient remedy to Life with Passion for violations of these Terms and you consent to injunctive or other equitable relief for such violations. You agree that Abusive Use of the Site, as defined above, causes damage and harm to Life with Passion in the form of, among other things, impaired goodwill, lost sales, and increased expenses associated with responding to Abusive Use of the Site. You further agree that monetary damages for Abusive Use of the Site are difficult to ascertain and that proof of monetary damages for Abusive Use would be costly and inconvenient to calculate. Accordingly you agree that liquidated damages are warranted for Abusive Use. Therefore, you agree that if you, or others acting in concert with you, alone or collectively request more than 1000 pages of the Site in any twenty-four hour period, you, and those acting in concert with you, will be jointly and severally liable for liquidated damages in the amount of ten dollars ($10.00) per page request each time that a page request is made after that first 1000 during that twenty-four hour period. You also agree that this will be the measure of damages for any Abusive Use that occurred prior to this provision of these Terms of Use being in effect. Life with Passion is not required to provide any refund to you if it exercises any of its rights or remedies because you have violated these Terms or any of Life with Passion's rights. For more information about how we handle copyright infringements on the Site, please see our Copyright Policy. Additionally, we reserve the right, in our sole discretion, to modify, suspend or discontinue any part of this Site at any time, with or without notice to you. We also reserve the right, in our sole discretion, to impose limits on certain features and services and to restrict access to any part or to all of the Site without notice to you. We shall not be liable to you or any third party for any claim or cause of action arising out of our exercise of the foregoing rights.PrivacyWe believe that your privacy and the privacy of all our users is important. These Terms are subject to the Privacy Policy, which is hereby incorporated by reference. Life with Passion will not be responsible or otherwise liable for any use or disclosure of your contact information, or financial information, by a third party to whom Life with Passion is allowed to disclose your contact information under the Privacy Policy. If you post any User Content to the Site, by electronic mail or otherwise, we will treat it as non-confidential and non-proprietary to you. When we say in these Terms "post" we mean the provision of information (including, but not limited to, "User Content") to the Site through features of the Site that are used to make information available to other members of the public (e.g., user reviews, bulletin boards, chat rooms, etc.). Information that is posted to the Site shall not be subject to the Privacy Policy and may be publicly displayed and disclosed and otherwise used by Life with Passion or any third party in any way. By posting User Content to the Site, you authorize us to use or allow others to distribute, reproduce or otherwise use such User Content. You should not post information about yourself on the public part of the Site that can be used to identify or contact you, including, but not limited to, your name, home or work address, phone numbers, pagers, email address or other such information except when creating user login to use booking feature. If you post such information, Life with Passion cannot prevent it from being used in a manner that violates these Terms, the law, or your personal privacy and safety. By posting such information on the Site, you violate these Terms, and you assume the risks and sole liability for the results of such posting. Life with Passion is not liable for any lost data resulting from the operation of the Site or the enforcement of the Terms. We urge all users to maintain their own backup versions of any User Content or other information they submit to the Site.Copyright PolicyWe will terminate the privileges of any user who uses this Site to unlawfully transmit copyrighted material without a license, express consent, valid defence or fair use exemption to do so. In particular, users who submit User Content to this Site, whether articles, images, stories, software or other copyrightable material must ensure that the User Content they upload does not infringe the copyrights or other rights of third parties (including, but not limited, to trademark, trade secret, privacy or publicity rights). After proper notification by the copyright holder or it agent to us, and confirmation through court order or admission by the user that they have used this Site as an instrument of unlawful infringement, we will terminate the infringing users' rights to use and/or access to this Site. Life with Passion MAKES NO GUARANTEE OF ANY SPECIFIC RESULT FROM USE OF THIS SITE OR USE OF THE Life with Passion SERVICE. Life with Passion DISCLAIMS ANY AND ALL LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTY USERS, Life with Passion USERS, ADVERTISERS AND/OR SPONSORS ON THE SITE, IN CONNECTION WITH THE Life with Passion SERVICE OR OTHERWISE RELATED TO YOUR USE OF THE SITE AND/OR THE Life with Passion SERVICE. Purchase Policy

1. IntroductionOur goal at Life with Passion is to make your purchasing experience easy, efficient and equitable, so we can get you on your way to events as quickly as possible. The following policies are designed to ensure your satisfaction and understanding of our purchase processes. If you have any questions about the information below, please contact to contact@lifewithpassion.org.For tickets purchased through www.lifewithpassion.org, this Purchase Policy is subject to, and incorporates by this reference, the Terms of Use.Each ticket that you purchase is a licence to attend a particular event and is subject to the additional terms set forth on that ticket.2. Pricing and AvailabilityLife with Passion sells tickets on behalf of Event Partners, which means Life with Passion does not set the ticket prices or determine seating layouts. Tickets are generally sold through several distribution points, including online, contact centres, outlets and box offices. Most distribution points generally access the same ticketing system and inventory. Therefore, tickets for popular events may sell out quickly. Occasionally, additional tickets may be available prior to the event. However, Life with Passion does not control this inventory or its availability.4. Cancelled EventsOccasionally, events are cancelled or postponed by the Event Partner due to weather conditions or other situations which may affect the performers, staff or audience. If an event is cancelled, please contact Life with Passion for information on receiving a refund. Unless indicated otherwise in relation to a particular event, if an event is cancelled or rescheduled, ticket purchasers will be offered seats at any rescheduled event up to the face value of the original tickets or, if the ticket purchaser is unable to attend the rescheduled event or the event is not rescheduled, a refund. Refunds for tickets purchased prior to the date of the original event will be given up to the amount paid for the tickets (excluding per transaction handling fees) but will normally exclude any delivery fees paid in respect of the tickets. Depending on the circumstances in each case, a partial refund may be given where one day of a multi day event is cancelled. Contact Life with Passion for exact instructions if an event is cancelled or rescheduled. Please make sure to include/provide your Life with Passion order number so we can expedite your refund (if applicable). If you purchased a ticket at a retail outlet, you will need to return the ticket directly to that retail outlet.It is your responsibility to ascertain whether an event has been cancelled and the date and time of any rescheduled event. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify ticket purchasers of the cancellation once we have received the relevant authorisation from the Event Partner. We do not guarantee that ticket purchasers will be informed of such cancellation before the date of the event.5. Opening ActsOpening acts or guests may sometimes tour with headlining performers. Life with Passion is not always made aware of opening acts or the length of their performances. These opening acts are subject to change or cancellation at any time without notice. Ticket holders will not be entitled to a refund if an opening act is changed or cancelled.Event Partners generally reserve the right to add, withdraw or substitute such artists and vary advertised programs, seating arrangements and audience capacities.6. Refunds, Exchanges and Replacement TicketsBefore purchasing tickets, carefully review the event and seat selection details. Life with Passion does not issue an exchange or refund for a lost, stolen, damaged or destroyed ticket (including where a ticket does not arrive in the mail) unless (a) Life with Passion can identify at the Venue the actual seat corresponding to the ticket for that event, or in the case of a general admission ticket, Life with Passion is able to identify (acting reasonably) and cancel the relevant ticket, and (b) you give Life with Passion a reasonable amount of notice ahead of the event that the ticket has been lost, stolen, damaged or destroyed, in which case Life with Passion will issue a replacement ticket to you for a reasonable administration fee. A change in personal circumstances does not entitle a ticket holder to return or exchange a ticket.Subject to any statutory rights of refund (including, without limitation, the provisions of the Australian Consumer Law), if an event takes place then generally there is no right to a refund or exchange, including where a ticket holder cannot attend because of adverse weather conditions.7. Billing Information VerificationOrders are processed only after a billing address and other billing information has been verified. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. In these cases, Life with Passion customer service will attempt to contact you using the information provided at the time of purchase. If Life with Passion is unable to reach you after its initial attempt, Life with Passion may cancel your order and may sell your tickets to another customer.8. Delivery of Tickets and Venue Pick UpIf you have selected delivery through the mail, please allow at least 14 days after your order is made to receive your tickets. Life with Passion sends tickets to the billing address of the charge card holder. Occasionally, we receive incorrect billing or credit card account information for a ticket order that can delay processing and delivery. Tickets delivered through Venue Pick Up are typically available one hour prior to the event start time. You will need to present your confirmation number, the credit card used to purchase tickets and picture identification. Some events do not have Venue Pick Up (in this case you will not get Venue Pick Up as a delivery option when ordering tickets).9. Pricing and Other ErrorsIf you are able to order a ticket before its scheduled on-sale or presale date or you are able to order a ticket that was not supposed to have been released for sale, then Life with Passion will have the right to cancel that ticket (or the order for that ticket) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of a Site or other Life with Passion operated system.If we discover an error in the price of tickets you have ordered (regardless of the source of that error, and whether it was an error in a price posted on a Site or otherwise communicated to you), we will inform you as soon as possible and give you the option of reconfirming your order at the correct price (and credit or debit your account as applicable) or cancelling your order. If we are unable to contact you, you agree that we may treat the order as cancelled. If you choose to cancel after you have already paid the incorrect ticket price for the tickets, you will receive a full refund from us.10. Limitation of LiabilityTo the extent permitted by law (including, without limitation, the Australian Consumer Law), neither the Event Partner nor Life with Passion shall have any liability to you beyond the face value of the ticket purchased plus any relevant per transaction handling fee and delivery fee. Neither the Event Partner nor Life with Passion shall be liable for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the event which have been arranged by you are at your own risk. The Event Partner and Life with Passion accept no responsibility for any personal property. This provision does not affect your rights or remedies in relation to any Consumer Guarantee that may be applicable to the Event Partner or Life with Passion's services.11. Injury at eventsTo the extent permitted by law, Life with Passion disclaims all liability for any injuries caused at an event. Balls or other objects may fly into the spectator area during events. Although reasonable measures are taken by the Event Partner to protect spectators, injury can occur. Stay alert at all times before, during and after the event. If struck or otherwise injured or distressed, immediately ask a staff for assistance or directions to a medical station or contact an emergency service. By purchasing a ticket for an event through Life with Passion, or by using a ticket purchased through Life with Passion for entry to an event, you acknowledge and accept these terms and conditions in your personal capacity and on behalf of any accompanying minor. You assume all risks which are incidental to the relevant event, whether before, during or after the event. Life with Passion, in acting as agent for the Event Partner, will not be liable for any obligations owed by the Event Partner to you as a ticket purchaser or ticket holder.12. License; Ejection and Cancellation; No Redemption ValueEvent Partners reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct the Event Partner or their agents, employees or contractors deems to be disorderly, who uses vulgar or abusive language or who otherwise fails to comply with the Event Partner's or the Venue's terms and conditions. A ticket is a revocable licence and breach of any such terms and conditions will terminate your licence to attend the event without refund or compensation. A ticket is not redeemable for cash.All patrons attending an event must hold a valid ticket for that event. Late arrivals to an event may result in non-admittance until a suitable break in the performance.13. Recording, Transmission and ExhibitionCameras, video and audio recorders, mobile phones and pagers may not be permitted in certain venues.You agree not to record or transmit, or aid in recording or transmitting, any description, account, picture, or reproduction of the event. You grant permission to the Event Partner to utilise your image, likeness, actions and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after the event) in any medium or context without further authorisation or compensation.14. You Are Subject to SearchYou may be requested to submit yourself and your belongings to a search on entry to an event for which you hold a ticket. By purchasing a ticket from Life with Passion or using a ticket to gain entry into an event, you consent to such searches and waive any related claims that may arise (to the extent permissible by law). If you withdraw your consent to such searches, you may be denied entry to the event without refund or other compensation. Event Partner rules may prohibit certain items from being brought into the Venue, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, bundles and containers. Such items may be confiscated and neither Life with Passion, Event Partners nor the Venue accept any responsibility for confiscated items.15. Unlawful Resale of Tickets; Commercial PurposesThere are laws in place in certain states that prohibit resale of tickets to certain events or limit the prices at which they may be resold. As a ticket purchaser, you are responsible for complying with any such laws.A ticket shall not be used for advertising, promotions, contests or sweepstakes, unless formal written authorisation is given by the Event Partner, provided that even if such consent is obtained, use of Life with Passion's trademarks and other intellectual property is subject to Life with Passion's express consent.When purchasing tickets on a Site, you are limited to a specified number of tickets for each event (also known as a 'ticket limit'). This amount is included on the unique event page and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices. Use of automated means to purchase tickets is strictly prohibited.16. Keeping tickets safePlease ensure that upon receipt of your tickets that they are kept in a safe place. To safeguard your tickets you may choose to have them sent by Registered Post at an additional cost. Allow 14 days delivery time for this method. Tickets sent by normal mail or express delivery cannot be traced and no responsibility will be taken for tickets sent by this method. Alternatively your tickets may be collected from the Venue on the day of the performance. Please check box office operating hours. In some instances where a venue collection is not available, alternative arrangements may be offered. Please check the purchase page for that event.17. For tickets purchased through a Site the following terms also apply:17.1 Multiple Browser WindowsWhen ordering tickets online at a Site, please ensure you are looking for tickets and placing an order using only one tab in one browser window. Looking up tickets using multiple browser windows or tabs could result in losing your tickets or timer expiration.17.2 Order ConfirmationDetails of all successful and completed ticket purchase orders are sent to the purchaser (in the form of a confirmation page or email) with a confirmation number. If you do not receive a confirmation number after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with the Customer Service Department whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. Life with Passion will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.17.3 FeesThe price shown for tickets on a Site includes GST and, where applicable, per ticket fees but excludes fees that are calculated on a per transaction basis. Per transaction fees are added to the final total of your order. The fees calculated on a per transaction basis are handling fees and delivery fees. Handling fees cover the costs of providing ticketing services, including things like infrastructure costs and operating an internet site. Handling fees vary depending on the event and are agreed between the relevant Event Partner and Life with Passion. The delivery fee depends on which delivery option/s are available and selected by you at checkout. Delivery options that normally attract delivery fees include Express Mail, Registered Post, International Airmail and International Express. The delivery options that attract delivery fees for an event and the applicable fee for each option, are displayed on the 'Find Tickets' page for the event on the Site.17.4 Amount of Tickets Per Customer or 'Ticket Limits'When purchasing tickets on a Site, you are limited to a specified number of tickets for each event (also known as a 'ticket limit'). This amount is included on the unique event page and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices.17.5 CurrencyAll ticket prices for events that occur in Australia are stated in Australian Dollars.
